Terms of Service

These Terms of Service govern access to the GHapp website, web application, and related services. By creating an account or using the Service, you agree to these Terms and the GHapp Privacy Policy.

1. About the Service and Contact Information

GHapp is a web service for AI-powered image and video generation through a unified interface. The Service may include generation features, a private gallery, a user account, activity history, a billing interface, support, and other related features.

The Service is provided under the GHapp brand. For support, complaints, privacy matters, and abuse reports, you may contact us at: support@ghapp.co.

If applicable law requires publication of additional legal information about the service operator, such information may be published on the GHapp website or provided upon a reasonable request.

2. Eligibility to Use the Service

You may use the Service only if you are at least 18 years old, have the legal capacity required to enter into a binding agreement, and your use of the Service is not prohibited by applicable law.

You may not use the Service if you are located in a sanctioned, embargo-restricted, or otherwise prohibited jurisdiction, or if you act on behalf of a person or entity subject to sanctions, export restrictions, trade prohibitions, or similar legal restrictions.

3. Description of the Service

GHapp provides a web interface through which users may submit text prompts, upload permitted input materials, receive generated results, and view them in their account.

The Service does not currently provide a public API for end users.

Features, models, providers, generation parameters, user interface elements, limits, and available capabilities may change, be suspended, or be discontinued at any time.

Generated results are private by default and are available only to the account owner in the private gallery unless the user chooses a different way to use or share them.

4. Third-Party Providers and AI Limitations

The Service relies on third-party infrastructure, AI models, hosting, and other third-party services. As a result, the availability, speed, quality, style, accuracy, and consistency of outputs may vary.

  • outputs may be unavailable, delayed, rejected, filtered, blocked, or interrupted;
  • specific models or providers may be replaced, removed, or become unavailable;
  • generated content may be incomplete, inaccurate, low quality, or unsuitable for your purpose;
  • generated outputs may be non-unique, and similar outputs may also be created for other users.

You are solely responsible for reviewing whether outputs are acceptable, lawful, safe, accurate, and fit for your intended use.

5. Account and Security

To use the Service, you must create an account with a valid email address and password.

  • provide accurate and up-to-date account information;
  • maintain the confidentiality and security of your credentials;
  • not share your account or credentials with others;
  • notify us immediately of any suspected unauthorized access, misuse, or security incident;
  • use the Service only through the interfaces we provide.

You are responsible for activity conducted through your account unless applicable law requires otherwise.

6. Billing, Balance, and Paid Features

As of the last updated date of these Terms, GHapp may display to users a billing interface, usage history, bonus or test balance, and related account information. However, paid balance top-ups, subscriptions, live checkout, and processing of real user payments may remain unavailable until the relevant features are separately launched.

If and when GHapp enables paid features, balance top-ups, subscriptions, checkout, or payment processing, such features may be subject to additional pricing, billing, payment, anti-fraud, refund, and third-party payment-provider rules. Those terms may be published in the Service interface, in separate policies, or in supplemental terms.

We may, at our discretion, provide promo balance, bonus balance, trial access, free features, or other benefit mechanisms. Unless expressly stated otherwise, such benefits have no cash value, are non-transferable, may not be exchanged for cash, and are not subject to mandatory renewal.

7. Your Content

“Your Content” means any prompts, text, images, videos, files, instructions, reference materials, and other input data that you upload, submit, or otherwise make available through the Service.

You retain rights in Your Content to the extent those rights belong to you. At the same time, you grant GHapp a limited non-exclusive license to store, process, transmit, display, and use such content solely to the extent necessary to operate the Service, fulfill your requests, display history and results, support users, prevent abuse, investigate incidents, and comply with legal obligations.

You represent and warrant that you have all rights, permissions, and lawful grounds necessary to upload and use Your Content through the Service.

8. Generated Results

Subject to your compliance with these Terms, you may use results made available to you through the Service for personal or commercial purposes unless otherwise limited by third-party rights, provider restrictions, or applicable law.

Your use of the Service does not grant you any rights to the models, weights, software, APIs, infrastructure, internal logic, or other technologies used to operate GHapp.

We do not guarantee that outputs will be unique, non-infringing, lawful, accurate, or fit for any particular purpose.

9. Prohibited Use

You may not use the Service to create, upload, request, store, transmit, promote, or distribute content, or engage in conduct, that:

  • is unlawful or facilitates unlawful activity;
  • involves exploitation of minors, CSAM, non-consensual intimate content, or sexual violence;
  • infringes copyright, trademark, publicity, privacy, or other third-party rights;
  • is fraudulent, deceptive, intended for impersonation, phishing, spam, malware, credential theft, or other harmful cyber activity;
  • is intended to evade sanctions, export controls, trade restrictions, or similar legal requirements;
  • supports terrorism, violent extremism, unlawful aggression, war crimes, or other serious violence;
  • circumvents safety filters, moderation systems, technical restrictions, rate limits, or other protective mechanisms;

We may investigate suspected violations, remove content, block requests, restrict features, suspend access, preserve evidence, and cooperate with law enforcement, payment providers, infrastructure providers, and other competent persons where appropriate.

10. Monitoring, Moderation, and Enforcement

We may, but are not obligated to, monitor use of the Service for security, abuse prevention, fraud investigation, compliance with sanctions and other legal requirements, maintenance of billing integrity, and enforcement of these Terms.

For these purposes, we may analyze account activity, prompts, uploads, outputs, technical logs, metadata, support communications, and other relevant records.

If we reasonably believe that your use of the Service violates these Terms, applicable law, or creates legal, operational, reputational, or safety risks, we may reject a request, remove or hide content, limit functionality, place the account under review, suspend, or terminate access to the Service.

11. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service with or without prior notice where reasonably necessary, including when:

  • you violate these Terms or applicable law;
  • you attempt to gain unauthorized access to the Service or misuse it;
  • your activity creates sanctions, legal, anti-fraud, technical, operational, or reputational risks;
  • we are required to do so by law, court order, a payment provider, an infrastructure provider, or another mandatory compliance requirement;
  • continued provision of the Service becomes legally, technically, or commercially impracticable.

12. Deletion of Content and Account

If you delete materials, generation history, or your account through the Service interface or by contacting support, access to the relevant data may be limited or terminated immediately. However, actual deletion from production systems, databases, object storage, backups, security logs, or other technical layers may occur with delay within a reasonable period necessary for operation of the Service, information security, abuse prevention, backup, recovery, and compliance with legal obligations.

13. Disclaimer of Warranties and Limitation of Liability

The Service is provided “as is” and “as available” to the maximum extent permitted by law. We make no warranties, express or implied, regarding availability, uninterrupted operation, quality, accuracy, meeting expectations, merchantability, or fitness of the Service for a particular purpose.

To the maximum extent permitted by law, GHapp is not liable for indirect, incidental, special, punitive, or consequential damages, loss of profits, loss of data, loss of goodwill, business interruption, or other harm arising from or related to use of, or inability to use, the Service.

14. Changes to the Terms

We may update these Terms from time to time. The updated version becomes effective on the date of publication unless stated otherwise. By continuing to use the Service after the changes become effective, you agree to the updated version.

15. Governing Law and Disputes

Unless otherwise required by applicable consumer protection law, these Terms are governed by the law determined by the location of the service operator or another applicable legal regime identified in mandatory notices on the GHapp website. Where possible, disputes should first be addressed through good-faith pre-trial resolution by contacting support@ghapp.co.
